Lahore High Court Dismisses Writ Petition against No-Confidence Motion in Bahawalpur Chamber of Commerce and Industries  

 

Islamabad 03-04-2025: The Lahore High Court, Bahawalpur Bench, has dismissed a Writ Petition challenging the legality of a No-Confidence Motion against the President of the Bahawalpur Chamber of Commerce and Industries (BCCI). The petition contested the validity of two letters directing the convening of an executive committee meeting to table the motion.  

 

Mr. Justice Syed Ahsan Raza Kazmi, in his ruling, upheld the directions issued by the Director General of the Trade Organization, stating they were lawful and aligned with the Trade Organization Act, 2013, and the Companies Act, 2017. The Court emphasized that trade organizations, being registered entities under the Companies Act, must adhere to its provisions, including procedures for removal of office-bearers.  

 

The petitioner argued that the Articles of Association and Trade Organization Rules did not provide for a No-Confidence Motion. However, the Court ruled that the Companies Act, 2017, applies to trade organizations and provides a mechanism for such removals. It also observed that the petitioner had an alternative remedy available under Section 21(2) of the Trade Organization Act, rendering the writ petition non-maintainable.  

 

With this ruling, the BCCI executive committee is now legally empowered to proceed with the No-Confidence Motion, potentially leading to a leadership change within the organization. The case reaffirms the authority of regulatory bodies in overseeing trade organizations and enforcing compliance with corporate governance laws.
