Medical Evidence alone is Insufficient to establish Guilt without Credible Eyewitness Testimony --- Supreme Court of Pakistan acquitted Accused due to Lack of Evidence and Credibility Issues
Islamabad 11-03-2025: The Supreme Court of Pakistan, in its recent decision, acquitted accused person in [Criminal Petition No. 231/2021], overturning prior convictions from the Islamabad High Court (IHC) and trial Court.
The Supreme Court of Pakistan bench comprising Mr. Justice Muhammad Hashim Khan Kakar and Mr. Justice Ishtiaq Ibrahim ruled that the prosecution failed to prove its case beyond reasonable doubt. The judgment highlighted significant deficiencies in the prosecution’s evidence, including a lack of direct eyewitness testimony and inconclusive medical evidence.
Mr. Justice Muhammad Hashim Khan Kakar emphasized the principle that medical evidence alone is insufficient to establish guilt without credible eyewitness testimony. Citing landmark precedents such as Zakir Hussain Vs. State (2008 SCMR 222) and Ata Muhammad Vs. State (1995 SCMR 599), the Court clarified that medical reports are corroborative, not conclusive, pieces of evidence.
The Court further pointed out serious credibility issues with the complainant, who was found to have submitted a fabricated affidavit, leading to Criminal charges against him for forgery. Additionally, the Court noted the absence of forensic evidence linking the alleged murder weapon to the crime.
Concluding the judgment, the Supreme Court of Pakistan ordered the immediate release of accused person, emphasizing the prosecution’s burden to conclusively establish guilt.
