Land Development Stalemate in Sector G-12 and F-12 --- Islamabad High Court, Islamabad Intervenes
Islamabad 11-05-2024: In a recent development, Islamabad's legal landscape has seen a significant intervention by the judiciary in a case concerning the development of Sectors G-12 and F-12 in the Islamabad Capital Territory. The case, [W.P.No.2610 of 2017], has brought to light a longstanding issue of land development and possession. The judgment, delivered by Mr. Justice Miangul Hassan Aurangzeb, highlights the failure of the Capital Development Authority (CDA) to fulfill its obligations under the Capital Development Authority Ordinance, 1960. Despite acquiring land in the aforementioned sectors, the CDA has neglected to take possession, resulting in rampant unauthorized construction and a subsequent deterioration of the law and order situation.
Moreover, the responsibility for the development of these sectors has been shifted to the Federal Government Employees Housing Authority (FGEHA). However, the FGEHA has failed to take substantive steps towards development, exacerbating the situation further. To address these pressing concerns, the court has summoned the Secretary of the Ministry of Interior to provide insights into the matter. Additionally, a meeting has been ordered between the petitioners, representatives of the Ministry, the CDA, and the FGEHA. The aim of this meeting is to devise measures to address illegal encroachments and facilitate the possession of land acquired by the CDA.
Furthermore, in a move to ensure comprehensive understanding of the case, Mr. Hamid Nawaz Awan, Advocate, has been appointed as amicus curiae. His role is to assist the court in grasping the broader implications of the issues at hand. With the next hearing scheduled after two weeks, stakeholders are expected to submit a report outlining progress made towards resolving the land development stalemate in Sectors G-12 and F-12. This judicial intervention marks a crucial step towards addressing longstanding grievances and restoring order in Islamabad's urban landscape.
